Fixed Fee Tenant Eviction: What Service Do You Need?

When it comes to evicting a tenant from your property, most cases go down one of two routes: Section 21 or Section 8. Letโ€™s break down what those are and what they mean for you:

Section 8 Notice

A Section 8 notice of tenant eviction is used when your renter is in breach of contract. What this breach is depends upon the lease contract you signed with them.

It can also refer to the legally restrictive covenants within a lease or freehold document. These may vary according to the specific estate you are renting but are potentially just as important as the lease between you and your tenant.

Section 21 Notice

A Section 21 notice of tenant eviction is used in cases of ‘no fault’. This means that, as a landlord, you do not have to prove any fault on the part of the tenant during the eviction process.

You can use a Section 21 notice to evict your tenant either after a fixed-term tenancy ends or during a tenancy with no fixed end date.

While Section 21 tenant eviction notices are currently still legal, we may soon see the end of โ€˜no faultโ€™ Section 21 evictions. Step 1 - Serve Notice


We complete an in-depth review of your case based on the information you provide us. From there, we offer advice on the action and next steps required. ย 

From there, we advise you as to whether a Section 21 and/or Section 8 process would be the most effective route to possession. We strive to ensure you reclaim your property in the quickest and most effective manner possible.

We draft and serve the appropriate Section 21 or Section 8 notice and provide a court-approved certificate of service. We may then also provide a document compliance check. This check ensures that all your documents are in place and compliant to proceed to court claim if required.

Step 2 - Claim for Possession

This process triggers in the event that your tenant does not vacate after the notice has expired. At this point, it will be necessary to make a possession claim through the county court. Our experienced team of paralegals will complete all of the paperwork required in preparation for the application to be sent to the county court.

We will complete the relevant applications, collate and index your documents and submit them to court. We also pay the necessary fees through our court account to start the claim process.

If a hearing is called, our expert advocates are on hand to represent and accompany you in court.

Step 3 - Bailiff Tenant Eviction

Once your possession order has been granted, if the tenant remains in the property, we:

  • Organise a tenant eviction date through the county court.
  • Complete the bailiff risk assessment.
  • Pay the necessary fees through our court account.

If permission to transfer your possession order to the high court is granted, we will transfer through our HCEO to obtain a writ of possession. In some instances, this can be a faster process as high court enforcement officers are employed directly by Eviction Support.
