3 Steps to Possession

How it works

Gaining possession of a property involves a series of steps, and two common procedures used in the United Kingdom are Section 8 and Section 21. The first step is to serve the tenant with a notice, either a Section 8 notice or a Section 21 notice, depending on the circumstances. A Section 8 notice is typically used when there are grounds for eviction, such as rent arrears or anti-social behaviour. On the other hand, a Section 21 notice is used when the landlord wishes to regain possession of the property without providing a specific reason.

If your tenant refuses to leave once the notice has expired, the second step is to apply to the court for a possession order. The court will review the case and, if satisfied, grant a possession order, this will instruct the tenant to vacate the property by a specific date. In the event the tenant decides to ignore the date for possession it will become necessary to enforce the possession order, this will involve using court-appointed bailiffs to evict the tenant from the property. As with all legal action, It’s important to get expert advice as almost half of possession claims fail or are returned due to incorrect procedure.

Step 1 โ€“ Serve Notice

Step 2 โ€“ Claim for Possession

Within 24 hours of the expiry of the initial notice, we will draft and submit papers to the County Court to instigate formal legal proceedings to recover the arrears of rent and possession of the property. Should a hearing be required our appointed advocates will attend court to act on your behalf. Our expert advocates will support and represent you every step of the way.

Step 3 โ€“ Bailiff Attendance

Whilst most tenants leave when ordered by court, a possession order does not guarantee possession. If your tenant decides to ignore the court order, we will arrange for bailiffs to attend, in order to enforce the possession order.
